Terms of use
These terms apply when you use Lota: the app, the lotamind.com website and the waitlist. By using any of them, you agree to these terms. If you don't agree, please don't use Lota.
How we handle your data is explained separately in our privacy policy.
Who we are
Lota is run by Aku Online Ltd. (“Lota”, “we”, “us”), a company registered in England and Wales. You can contact us at support@lotamind.com.
Who can use Lota
Lota is for adults. You must be 18 or over to use it, and by using it you confirm that you are. Lota is for personal use, not for running a business or keeping records for clients.
The waitlist
Joining the waitlist means we'll email you when Lota is ready to download. It doesn't reserve a place, a price or a launch date, and you can leave at any time.
Your account
- You sign in with Apple or Google. Keep that account secure: you're responsible for what happens under it.
- Give us accurate information, and tell us if you think someone else has accessed your account.
- You can delete your account at any time from Settings.
Your sessions and recordings
They're yours
You own your recordings, notes and everything Lota creates from them, such as transcripts, summaries and goals.
What you allow us to do
When you ask Lota to process a recording or answer a question, you allow us and our providers to process that content only to give you the result. We don't use your content for anything else, and we don't let anyone use it to train AI.
Ask before you record
Always ask your therapist, or anyone else in the conversation, before you record. Recording laws differ between countries, and some require everyone's permission. You're responsible for having the permission you need. If someone would rather not be recorded, you can record your own reflection afterwards instead.
Sessions live on your phone
Lota keeps your sessions on your phone rather than on our servers. That protects your privacy, and it means you're in charge of your own copies:
- If you lose your phone, reset it or delete the app, we can't recover your sessions unless you've exported them or your phone's own backup includes them.
- Use Lota's export option to keep a copy somewhere safe.
- Keep your phone protected with a passcode, and consider turning on Lota's app lock.
AI features
Lota uses AI to transcribe recordings, write summaries, find themes, suggest goals and answer your questions. AI can make mistakes: a transcript may mishear words or mix up who said what, and a summary may miss something or get it wrong. Check anything important against the recording.
Lota doesn't give medical, psychological or other professional advice, and it isn't a substitute for therapy or professional care. Don't use it in an emergency. If you're in danger or in crisis, contact your local emergency services.
Free use and paid plans
- Free use: you can use Lota for free within an allowance, such as a number of sessions or minutes of processing each month. The app always shows your current allowance. We may change free allowances, and we'll tell you before a change affects you.
- Subscriptions: paid plans are sold and billed by the Apple App Store or Google Play. The price, billing period and any taxes are shown before you buy.
- Renewal and cancelling: subscriptions renew automatically until you cancel in your App Store or Google Play account settings. Cancel at least 24 hours before the renewal date to avoid being charged for the next period. Deleting the app doesn't cancel a subscription.
- Refunds: Apple and Google handle refunds under their own policies. Your legal rights as a consumer aren't affected.
- Price changes: if we change the price of a subscription, you'll be told in advance through the App Store or Google Play and can cancel before it applies.
Using Lota responsibly
Please don't:
- break the law, or record people without the permission you need;
- upload content you don't have the right to use;
- try to break, overload, reverse engineer or get around the security of Lota;
- use bots or automated tools to access Lota, or resell it.
Other services
Lota relies on other companies, such as Apple and Google for sign-in, payments and app stores. Their own terms also apply when you use their services. Our privacy policy lists the providers we use.
Changes and ending
If you want to stop
You can stop using Lota at any time and delete your account from Settings. If you have a subscription, cancel it in your App Store or Google Play settings.
If we need to stop you
We may suspend or close your account if you seriously or repeatedly break these terms, or if we have to for legal or security reasons. Where we can, we'll tell you why first and give you time to export your sessions.
If we change or close Lota
We keep improving Lota, so features may change. If we ever close Lota, we'll give you reasonable notice so you can export your sessions, and refund any subscription time you've paid for but can't use, where the app store allows.
What we can and can't promise
We work hard to keep Lota useful and reliable, but we can't promise it will always be available, free of errors, or that AI results will be accurate. Lota is provided “as is”, as far as the law allows. This doesn't affect your legal rights as a consumer, including the right to a service provided with reasonable care and skill.
Our responsibility to you
- We're responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care. We aren't responsible for loss that wasn't foreseeable, or for business losses, because Lota is for personal use.
- We aren't responsible for losing sessions stored on your phone, for example if your phone is lost or reset, or the app is deleted before you've exported them.
- As far as the law allows, our total responsibility to you is limited to the greater of what you've paid us in the 12 months before the claim and £100.
- Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
Governing law and disputes
If you live outside the United States
These terms are governed by the law of England and Wales, and disputes can be brought in the courts of England and Wales. If you live in Scotland, Northern Ireland or the EU, you also keep the protection of your local consumer laws, and you can bring a claim in your local courts.
If something goes wrong, please contact us first at support@lotamind.com. Most problems can be solved quickly that way.
If you live in the United States
Please read this carefully. It affects your legal rights.
Talk to us first. Before filing a claim, you agree to try to resolve the dispute informally by emailing support@lotamind.com with a short description of the issue.
Arbitration. If we can't resolve it, any dispute about these terms or Lota will be settled by binding individual arbitration administered by the American Arbitration Association under its consumer rules, which may take place online. Either of us can instead bring an eligible claim in small claims court, or ask a court to stop infringement of intellectual property rights.
No class actions. As far as the law allows, disputes will be brought only on an individual basis, not as part of a class, collective or representative action.
Opting out. You can opt out of this arbitration section by emailing us within 30 days of first accepting these terms, with your name, your account email, and a statement that you're opting out. The rest of these terms will still apply.
Changes to these terms
We may update these terms as Lota changes. We'll update the date at the top, and if a change is significant we'll tell you in the app or by email before it takes effect. If you don't agree with the new terms, you can stop using Lota and delete your account.
